businesses here that is tied to some criminal activity. >> the number of people who got sick after eating at a restaurant in san jose continues to grow. the symptoms you need to watch out for even if you didn't eat there. 7:00 this wednesday morning. good morning, i'm gasia mikaelian. >> good morning, everybody i'm brian flores in for dave clark. let's get a quick look at weather and traffic. unlike dave clark i did not step outside. but i trust you steve. >> if you did it might be a little cooler. there are a lot of 40s here for over night lows from the north bay to the san to cruz mountains. a little bit of fog on the coast. not enough to make much on an impact anywhere expect for on the the coast. there is some visibility half- moon bay airport at a quarter of a mile. good morning from larkspur.

63.3 degrees and 39% humidity. humidity was very low. thomas smith down in blossom hill takes a walk every morning and says it will be cool on the trail this morning. 51 on blossom hill. there is a lot of 40s around as well. average is 75, 52. 89 in 1901. the fog is mainly off the coast but there is plenty working its way kind of flirting and dancing around on the santa cruz. there is a pretty good system down to the four corners. 49 saab ramon. 47 napa. 46 santa rosa. 40s yes gilroy at 48. and scotts valley at 46. santa cruz even cooler at 53. lots of sunshine inland. tomorrow we will start a cool down that goes away from the coast. not as breezy autoof the north, northeast. 80s through the interior but 60s and 70s closer to the

water. we've had a busy morning, sal. >> yes, we have. we are starting off in the east bay with a lot of slow traffic approaching the bay bridge which is obviously one of the main commutes be if not the main commute in the bay area that is backed up all the way around the maccarthur maze. 35-40 minute delay on this middle of the weekday. you can see traffic is going to be busy as you drive on the bridge as well. we're also looking at other things. we've had a lot of slow traffic in other parts of the bay. the peninsula. highway 101 in san francisco looks like it's okay here. a little bit of slowing on the central freeway getting on to southbound 101. i also want to mention southbound 880 is slow after earlier issues. the slowest part is between 237 and union city. we've lad a couple of problems there. some on the shoulder, some still blocking but you should try and get on the freeway after that if you can. i want to move the maps over to the livermore valley. westbound 580 just moderate

this morning. 7:02 let's go back to the desk. we continue to follow breaking news from sunnyvale. that is where a fire is burning at a strip mall. ktvu fox 2 janine de la vega is there. >> reporter: the flames did not reach that apartment complex so that is good news. they do have it contained. we don't see anymore flames. right now they are still spraying it but you can still see smoke rising so it could still be smoldering but they do have this contained. now they did cut a hole in the roof there so it's venting right now. what you're looking at is what used to be a barbershop. that is where most of the damage was. we were told by one of the other business owners that last week he was told by a police officer that somebody tried to set the taco roadway yeah on

fire. now we have not confirmed that information yet but we are definitely going to look into it. let's go top video we took earlier. this fire started at 5:00 this morning. flames were seen shooting out of the roof here at the barbershop. firefighters arrived and they attacked the fire but it quickly spread through the attic and it then spread to the other businesses. what is in here is a taco roadway yeah, a grocery store, and a liquor store. >> i walked out in the parking lot and saw the barbershop that recently opened. i saw flames coming out of the windows. glass was cracking. i heard two more pops.

at the other businesses they have heavy smoke damage. >> reporter: now we have not talked to that owner of the taco roadway yeah where the flames were made. a fire was trying to get set there last week. that owner seemed very distraught. we know a fire investigator is on the way here. we will call them over here in the next hour so we can give you an update on what is going on here. >> did you get a sense this morning if any of the three businesses in the strip mall were open at the time of the fire? or had they not open yet? >> reporter: no. no, it doesn't appear they were open. the owner of the liquor store

we spoke to he got a call at home. same thing with the taqueria. the other thing was a mexican grocery store. everything was closed. nobody was around because we asked one of the witnesses did you see anybody running away when he heard those explosions and they said no. all we saw was the flames. >> it's early. when you talk to the battalion chief, bring it back and talk to us. thank yous janine. now to developing news in mendocino county. that is where crews are searching for a missing five- year-old boy. the boy named bret was last seen in brookville. he was last seen working a dog. a black lab named hank at 4:30 yesterday afternoon when he went missing. at least 75 people including search and rescue crews are looking for him. marin county rescue is helping out as well. a couple of lanes at a busy intersection in union city are scheduled to open this morning.

the area has been closed off for a week now because of a sink hole. ktvu alex savidge is live on scene now. alex, have you seen any traffic move through there yet? >> reporter: no traffic just yet. the road was supposed to open any minute. things are still closed here but all the repair work is finished up here on alvarado boulevard where we are this morning where you can see the outline of this giant sink hole. crews have filled the sink hole. they have repaved part of the road. it's all set for cars to drive through here and they will be any minute now reopening one westbound lane of alvarado boulevard. the sink hole was spotted last wednesday at alvarado boulevard. just outside of alvarado middle school. the sink hole ruptured a water main and flooded as well. eventually it grew to 35 by 40 feet wide and ten feet deep. crews filled up the hole

although i'm told they have to repair a sewer line that was damaged during all of this. in the meantime union city officials are trying to piece together what caused this roadway to give way one week ago. but a whole lot of work has been done in that time. as we bring you back out here live, the sink hole all filled up here and the road repaved already for cars ready to come through but thus far traffic is not flowing through this area just yet. >> residents i'm sure are anxious for that road to open up there, alex. thank you so much. the number of people who got sick after eating at a san jose restaurant is continuing to grow and health officials expect that to continue. right now though the number of suspected cases of shigella linked to the mariscos san juan restaurant sits at 80. some of those cases include people who didn't even eat at the restaurant but were infected later probably by people who have eaten there. the restaurant is temporarily shut down and expected to remain closed for several days. the participants of a 31-year-

old shigella victim says this is the first time she had gone to the restaurant and hours later she was rushed to the hospital. >> we were so concerned she was shaking so hard. >> shattering. she said she had the chills and the diarrhea wouldn't stop. >> the bacteria is very infectious. and one of the common ways it's spread is by restaurant workers who don't wash their hands after using the restroom. there are three mariscos san juan restaurants in san jose. the other two will remain open. a grocery store that was shut down for health issues last month is closed again for the same problems. workers are inside the pueblo food center on north capital avenue this morning. there are signs on the windows saying it's closed for problems with rodents and insects and there is no word yet on when it will reopen. we tried to talk to workers and they referred all questions to their corporate headquarters.

when we called we heard a recording saying offices are open at 8:30 this morning. the marine f-18 jet went down today near a british air base in eastern england about 70 miles northeast of england. the jet was based out osteomere mar marine corp air station in southern california. it's believed the pilot was the only person on board the plane and the only victim in the crash. time is 7:10. is it clever advertisement or a tasteless joke. coming up the window disthere. >> this comes after congressman paul ryan says he will run for speaker of the house. but up next what ryan is demanding from his follow republicans. >> we are looking at a commute that is very busy. we have heavy traffic on the san mateo bridge heading to the peninsula. we'll tell you more about this coming up. >> there is a little bite.

the vatican is denying the report in an italian newspaper that pope francis has a small curable brain tumor. the report in the national daily says the 78-year-old pope traveled to a clinic in italy in recent months to see a japanese brain cancer specialist. the doctor determined that the small dark spot on the popes brain could be cured without surgery. the vatican spokesman called the publication quote completely unconfounded reports and not worthy of attention. the newspaper however says it stands by its story. president obama is taking steps to help people who battle with heroin and prescription painkiller abuse. and some of the help includes

doctor training and eases access to treatment for addiction. the white house says the president will meet with law enforcement officials, drug counselors, and advocates at a community center in west virginia today. according to a report, west virginia has the highest rate of over dose deaths in the u.s. which is more than twice the national average. time is 7:14. let's get you out the door. traffic troubles popping up early this morning aren't they sal? >> yes and all over the place. pretty much every area of the bay has them. we will start off with highway 24 this time around and take a look at highway 24 area you can straffing is slow here in lafayette. between walnut creek and oakland you will see a fair amount of slow traffic and also once you get to oakland you will see traffic there at the maccarthur maze that is going to be slow getting to the bay bridge toll plaza. it's a 25-30 minute delay. we can look at the toll plaza there and show you traffic is backed up to the foot of the maze as you saw that. once you get on to the bridge it does improve a little bit at

least. i want to mention in san jose i can put it up on the map for you. capital expressway near monterey highway. monterey highway and monterey road is very slow. the capital expressway is slow. there has been a deadly pedestrian accident. this is a good injure to avoid. san jose police would say avoid monterey road because it's very, very slow in the area. 7:15 let's go to steve in the weather center. sal, thank you. mostly clear this morning. i say that because fog is trying to inch its way back to the coast. but over all lots of sunshine. the breeze has tailed off. that gave a pretty good little warmup for some. especially sonoma county airport which was 89 degrees. well not today we will lose that breeze. san francisco 58 maybe some patching to. but still above average. the fog most of it is developing and merged off the

coast. some of it on the mendocino coast and a little bit continues to form san mateo and santa cruz and it's really thick. visibility on highway 1 can be very dicey. rather vigorous system and there will be really good rain out ahead of it. for us we are waiting for that system. it will be here tomorrow for a cool down. 46 santa rosa. i had reports it's chilly up here in roanoke park. 40s i know there was a 49 in san ramon. palo alto 49. lots of 40s in the santa cruz mountain. alamo has checked in at 48. 60s for pittsburgh. a couple upper 40s and low 50s. lafayette 44. 52 down in monterey.

system will eventually sweep in starting to increase the fog tonight and tomorrow. we have cooler weather on the way. today is that betweener day. tomorrow we'll have a little bit more in the way of fog. friday we will bring in a few more high clouds. we could have a little bit on the coast. that is the one so the system is there, i think it will stay north. but remains of hurricane olaf are showing signs of moving north. missing the hawaiian islands. category 3, 130 miles an hour as it moves north it will start to fall apart. there are hints it will get caught up in the jet stream and pay a visit here a week from today. a lot can happen but we're looking at it. sunshine nice to warm. 80s on some of these temps. richmond 76 to vacaville's 84. 77 oakland berkeley and san

leandro. low 80s as well. 60s on the coast. a little thick fog there so slightly cooler. upper 70s and low 80s on the peninsula. fog will be on the move and a cool down as we go into the weekend. >> pretty brisk out there for some. >> for some it is. just a few minutes ago we learned house speaker john boehner will schedule the house leadership elections for next week. this comes after paul ryan has agreed to replace boehner if his fellow republicans agree to his condition. doug luzader is live in washington this morning with the latest. doug. >> reporter: good morning. we know there will be the internal election for republicans on october 28th and the floor vote on october 29th. the question is will paul ryan at that point be a candidate? he says it's a possibility but there is a lot of strings attached. >> now we like to run. i hope you don't mind.

>> reporter: when paul ryan left his office yesterday he was in a hurry. but when he emerged from meetings with his fellow republicans he sounded more like a reluctant recruit. >> my greatest worry is the consequence of not stepping up. add some day having my kids ask me when the stakes were so high, why didn't you do what you could do? >> reporter: hang on ryan included some conditions and they may be deal breakers. among them a limited schedule to carve out more time with his family. and having seen what boehner faced in recent years trying to control his caucus, ryan wants near anonymous support from gop contenders. >> what i told members is, if you can agree to these requests and if i can truly be a unifying figure, thenly gladly

serve. and if i'm not unifying, that is fine as well. ly be happy to say where i am at the ways and means committee. >> reporter: one conservative member that was running for speaker says he is scrapping his bid now and backing ryan. but other conservatives may be skeptical and an endorsement from a prom inspect democrat harry reid seems to help. >> he looks like one of those people that would be reasonable. i'm a paul ryan fan. >> reporter: now as far as ryan is concerned, he has set this deadline for friday. he wants to know whether he is going to get broad support from the whole spectrum of republicans or else he is not going to run. we know the speaker election and the floor is going to be on october 29th. so if ryan isn't a candidate, who is next? and there is really no other consensus candidate we know of at this point and you have to have a house speaker for the house to operate at all.

the suspect was shot by officers but his injuries are not considered life threatening. there was an emotional scene in new york city. police officers gathered outside of a hospital and sam luted the balance that took away a body of a fellow officer killed in the line of duty. 33-year-old officer randolph holder was shot while chasing a suspect. after holder was shot his

partner wounded the suspect in the lake. the controversy over sanctuary city policies was the subject of a high profile hearing in washington, d.c.. senate democrats block legislation to crack down on cities that don't cooperate with federal immigration authorities. the republicans needed 60 votes to move the bill forward but they only got 54. republicans have pushed for change since kate steinle was shot and killed. undocumented immigrant was accused in his death. the board approved a plan from supervisor david campos reaffirming the sanctuary city policy. campos says it's important that unen documented immigrants know they can contact police to report a crime without fear of being deported. the supervisors voted against a proposal that would have called on sheriff ross mirkarimi so rescind his order. time is 7:25.

is slow traffic on southbound 101 approaching the 80 split and heading down to the caesar chavez area. it's not the greatest commute there either. moving along to the east bay. highway 4 we had a string of accidents in pittsburgh coming over the hill. 680 is also slow as you drive to the nimitz freeway. we had an earlier accident on 92. that is pretty solid down to some crashes we had in union city so this commute is slow. we go to the south bay where the freeways are all slow. i want to push into an area. monterey highway at capital expressway. a good intersection to avoid as they investigate a deadly auto pedestrian accident. 7:32 let's go back to the desk. we have an update to the breaking story in the south bay. witnesses report hearing explosions from a fire at a sunnyvale strip mall. the blaze began around 5:00 this morning at the mall near the sunnyvale golf course. the fire started inside a barbershop and quickly spread to nearby businesses including a taqueria and convenience

store. one of the business owners told our janine de la vega that police believe someone tried to set fire to the taqueria last week. janine is trying to confirm that story. there is a warning going out in the east bay. they have struck the atm at the east bank several times. under cover police arrested 33- year-old blade catrell of oakland in the two most recent cases. thieves watch users using the atm over their shoulder and pick up on their pass codes. if the customer fails to close out their banking session the thief can quickly take advantage. >> the second you step away with the money in your hand, your card back in the wallet. the suspect jumps over to the machine you have been on and reengage your account and reopen and continue transactions after that. >> san leandro police are sen couraging atm customers to hide

their pass codes, fully log out of their accounts and be wary if someone seems to be hovering nearby. ktvu fox 2 allie rasmus is live in san francisco with that window display. some people say it's distasteful. >> reporter: the display right here behind me is the one causing controversy. at first glance it looks like regular food cans stacked up. but if you take a look at the labels it says colorful sky rat boiled parrot in gravy. now obviously this is not really canned parrot. the owner of this store says he created this display as way to do something interesting to generate a little bit of buzz in the community before his store opened. the owner said he did not expect this much attention or reaction from people. some people find the display

much more offensive and funny. as you can see this letter, the the owner put the -- however we talked so some other neighbors who had a different take on the whole thing. >> i don't think it's offensive. i think it's a joke because no one eats parrot and there is parrots around here and everyone is protecting them. >> i'm not really offended by it. i'm shocked that so many people are. >> reporter: why? >> because this is a little art gallery and it's just one guy expressing himself. >> now the owner put this display up about a week ago. this store isn't open yet. the owner describes this as a novelty store. and the parrots are a local reference because there are a few wild parrots on telegraph hill. in addition to the critical letter we mentioned earlier. i want to point out someone else in the neighborhood wrote a supportive letter in response

airlines flight from san jose after it was diverted from phoenix. the flight was on its way to dallas yesterday. a passenger tweeted a picture in the aisle. a 26-year-old man appeared to be intoxicated. and then the man went back there to go to the bathroom. the nec thing i know they are holding him down. >> the passenger was sent on a phoenix hotel. oakland police are investigating a bizarre incident involving two drivers that hit a man that was vandalizing cars with a machete and the incident was caught on camera. >> you see it all happen here. someone on a balcony was taking this video early monday

morning. it shows a man swinging a machete at a red car and then the red car circles back and hits the man. and then a white car hits that man. police arrived to the scene shortly after the incident. the man with the machete suffered only minor injuries. he is arrested and now in a psychiatric hold. police want to talk to the drivers of the two cars. here they are. one was a red or maroon four door sundae. large section of that chain link fence fell from the over crossing monday night and it landed right on interstate 880. falling debris damaged eight cars driving by. people who drive in that area noticed the fence was tipping. a told ktvu he alerted a caltrans contractor two weeks ago but the fence seemed unstable. >> i called them and told them the fence was falling. no calls back.

no response. >> inspectors last checked the overcrossing in february. caltrans says it's trying to locate the report and its structural engineers are examining that bridge. the zone 7 water board is expected to vote on a plan to increase water rates once a year for the next three years. the contra costa times reports the water district is also considering an additional temporary surcharge. the paper says that is because the district has sold $5 million less water than expected as people cut back on water use because of the drought. if the measures are approved, the average household could see a price hike of nearly $8. unagile actress finally

san jose starting off with 280 in san jose. you will see the traffic is going to be slow this morning getting up to the valley. although it's improved a little bit. we don't want to be all doom and gloom here we do have some improvement. i want to mention we have the south bay freeway system on the maps. 101 is very slow. you stay away from the intersection of capitol expressway and monterey highway. they are clearing up a deadly pedestrian accident. so if you can all avoid the area, that would be a good area to stay away from. we also want to look at the east bay. we had slow traffic on 880 south from marina boulevard all the way down to union city. that is due to earlier problems. at the bay bridge toll plaza, it's backed up for a 20-25 minute delay. we're finally beginning to see some improvement here. 7:47 today's weather with steve. all right sal, thank you, sir. we have another beautiful day on tap. kind of windy in the east bay hills. but from around the caldecott

artist was shot and killed is finally complete. it's located under the 50 freeway overpass. police say 27-year-old antonio ramos was working on that mural when she was shot after an apparent argument with a man. the unvailing ceremony for the mural will be held from 2:00 to 4:00 p.m. today. early this month police released this surveillance image of a person of interest in the killing but no arrest has been made. the owner of a rare and classical instrument is hoping to get it back after it was stolen out of her car. someone stole the bass when she parked. the bass was made in germany. it's valued at $20,000. elizabeth says it was restored for her 15 years ago and says the bass is her livelihood. >> i have no idea what i would do next or how i would keep doing the things i've been doing without my instrument.

i think today we will start with sal. a lot of problems brewing sal. >> that is right we are looking at a lot of slow traffic. especially getting to the maccarthur maze. look at this. more an hour to get from the carquinez bridge to the maccarthur maze. that is just because of a lot of slow traffic. we haven't had any major crashes. we've had a couple minor ones but the bay bridge is going very slow. we can go right to the bay bridge and backed up for a long, long delay getting into san francisco. i do want to mention as we go to the maps, i can put it on the map for you. i showed you 580 getting into marin is slow. marin county traffic had a couple issues there that have been cleared from the lanes and highway 4 is still slow. whenever you go this is the heart of the midweek commute and it's very, very slow still. let's go back to steve in the weather center. expect for fog about half- moon bay south. now there is some to the north on mendocino coast but it did not make it to san francisco. at least not yet.

be sunny today. 60s and 70s and 80s. and back to gasia and also who is over there? brian. >> yes, sir. thank you very much. we continue to follow breaking news in sunnyvale. a fire broke out about three hours ago. >> ktvu fox 2 janine de la vega is there. we can see the fire is out but the investigation is just beginning. >> reporter: yeah it is, gasia. firefighters are taking a look at that building. you can see they have an aerial ladder up there looking at the roof. there is an investigator here because we still do not have a cause yet. one of the things they will be looking into is a small fire that happened here behind the building last week. it was at the bottom of a storage facility that is connected to this strip mall you are lookings at. and there appeared to be some sort of a burn pattern there. maybe lighter fluid. it may have been intentionally set. that was last week. take a look at the damage now.

today. it's mainly in the barbershop where you can see it's completely blackened. neighbors say they heard explosion and windows shattering just before 5:00 this morning. they looked outside and saw flames shooting from the strip mall. firefighters arrived and started hosing the building down but the flames spread throughout the attic area. the barbershop is a total loss. the taqueria and grocery store have smoke damage. the fire department will look at the damage and see if there is any connection. at this point they don't believe the two fires are related. >> based on proximity, we will look into everything and make sure we vet out all the details to determine if this one determines to be suspicious, then we have information from the previous one we can look into. >> reporter: firefighters cut a hole in the roof and venting the building. it's still smoldering at this hour. it was a challenge fighting it because it was an older

out of mendocino county where crews are searching for a missing five-year-old boy. bret was last seen walking his dog at 5:00 last night. the north coast news reports at least 75 people including search and rescue crews are looking for bret. marin county search and rescue is helping out as well. after a week of waiting and traffic delays, busy road in union city is open again. >> alvarado road was shut down because of a sink hole. and alex savidge is at the scene. >> big deal here for people who live in this neighborhood after a week of repair work there you go the road is back open to traffic this morning. this is alvarado boulevard right at new haven street. you can see the outline of that giant sink hole right in the middle of the intersection. crews spent the last week filling that hole. repaving part of the road. and now traffic can drive through this area.

this is a very big deal especially for parents as they try to drop their kids off at alvarado middle school. they tried to drive around this shut down intersection. there is quite a bit of relief for parents as they can get to school and make the drop offs much easier. this sink hole was last spotted last wednesday. right outside of the middle school. the sink hole ruptured a water main. it also flooded as well and eventually it grew to about 35 by 40 feet wide and it was 10 feet deep. but again crews have repaired this hole. they have filled it up over the last week. it's a huge relief. for parents we talked to who said they had to drive around this closure. >> normally there is traffic around here. and with that it's even more traffic. but i'm glad they are getting it fixed and nobody got hurt. >> reporter: now there is still one westbound lane of alvarado boulevard that will remain

closed for the foreseeable future that is because crews tell me they have to fix a sewer line here that was ruptured when the sink hole or the ground gave way here. union city officials are trying to figure out what caused this giant sink hole in the first place. but really the good news for neighbors in this area parents who need to make the drop off at alvarado middle school the road is back open to traffic. >> that is the major question this morning. >> one lane is better than none. but that final lane that is still closed, did you get any sense at all how long it will take before it's completely clear? >> reporter: no. i just had a conversation with one of the workers. they're glad to get one lane back open but they still have the sewer line that runs underneath the westbound lanes of alvarado boulevard. they will have to keep that lane closed. it will still be a construction zone if you will. but traffic at least can squeeze through. >> better than nothing.

thank you alex. there is a warning going out in the east bay about thieves using old fashion shoulder surfing to steal atm pass codes and cash. thieves are struck the bank of america on east 14th street several times starting back in may and last month. thieves watch a user and pick up their pass code. if a customer fails to close out their banking session, the thief can quickly take advantage. >> the second you step away with the money in your hand, your card back in your wallet, that suspect jumps over to the machine you have been on and reengage your account and reopen it and continue transactions after that. >> san leandro police are encouraging atm customers to hide their pass codes, and fully log out of their account. popular grocery store remains closed. workers are at new pueblo food center on north capital avenue but there are signs on the window saying the store is

closed with problems with rodents and insects and there is no word when the store will reopen. we tried talking to workers but they referred all questions to the corporate headquarters. when we called we got a recording saying the office is open at 8:30. just last month the grocery deli and bakery department were closed for a day for the same reason. time is 8:10. later this morning santa clara county officials are scheduled to release new information about the shigella outbreak linked to a san jose restaurant. the number of suspected cases of shigella linked to the mariscos san juan restaurant has grown to 80 people. some of those cases include people who didn't even eat at the restaurant but were infected later probably by people who ate there. the restaurant is temporarily shut down and expected to remain closed for several days. the participants of one 31-year- old victim says this is the first time she had gone to the restaurant and hours later she

was rushed to the hospital. >> we were so concerned she was shaking so hard. >> she said she had the chills and the diarrhea wouldn't stop. >> the bacteria is very infectious. one of the most common ways it spreads is by restaurant workers that don't wash their hands by using the restrooms. a substitute teacher from santa rosa is due in court on child pornography charges. 39-year-old ethan monroe morris was arrested last week. he texted photos of a young woman. those photos were not pornographic but the woman tells police he made sexual comments about those pictures. the press democrat reports morris worked in six santa rosa schools over the past two months. a lawsuit accuses california high school in san ramon of failing to come ply with state law over sex abuse allegations.

shore freeway. we will start there. it has become a little better. we have taken an hour to drive from the carquinez bridge to the maccarthur maze and it's a long time. especially with a lot of slow traffic in richmond. you will see slow traffic from hercules to el cerrito. let's go to the bay bridge toll plaza. traffic there is slightly better. by the time you make it to san francisco we've had a couple of problems on 101, also the peninsula traffic 101 is slow coming from south city into the city. 280 is a mess between daly city and san francisco. and 280 southbound leaving san bruno down to the crystal springs area is slow. so the peninsula is not having a good day. and marin this caught my eye between novato and san rafael. no breaks here. especially heavy as you drive down to central san rafael. let's go back to the desk. in national news a kentucky state trooper is in the hospital after being shot

during a traffic stop. investigators say the gunman stopped and then tried to run away from officers. when they tried to subdue him, he pulled out a gun and wounded the trooper. the suspect was shot by officers but his injuries are not considered life threatening. and in new york city police officers saluted the ambulance that carried the body of a fellow officer. 33-year-old officer randolph holder was shot and killed chasing a suspect last night in new york. holder was a third generation police officer. the accused gunman was caught after holders partner wounded him in the leg. a new york television station has identified the suspect as a 30-year-old from manhattan. new this morning the vatican is denying a report in an italian newspaper that pope francis has a small curable brain tumor. the report says the 78-year-old pope traveled to a clinic in italy to see a japanese brain cancer specialist. the newspaper says the doctor determined that the small dark

artist was shot and killed last month is complete. it's located right under the 580 freeway. police say 27-year-old antonio ramos was working on that mural when he was shot. the unvailing ceremony will be held at 2:00 this afternoon. now earlier this month you may remember police released this surveillance image of a person of interest in the killing. at this point no arrests have been made in the case. a fence that fell from an overcrossing in oakland was checked and approved by inspectors in february. a large section fell from the over crossing monday night and landed on interstate 880. the falling debris damaged eight cars that were driving by. people who drive in the area say they noticed the fence had been tipping over. the neighbor tells ktvu he alerted a caltrans contractor two years ago but the fence seemed unstable. >> called to them and i told them that fence was falling. no calls back. no response. >> inspectors last checked that

over crossing in february. ktvu asked caltrans what was written on the inspection report. caltrans now says it's trying to locate the report and its structure engineers are reviewing the overpass to determine the problem. that overpass by the way is scheduled to be replaced in 2018. california is trying to improve building safety following the balcony collapse. the sacramento b reports the state has been working on several safety proposals. one would require state notification if a contractor is convicted of a felony but this measure stalled in the legislature. now the bee reports a state building commission is considering corrosive resistance steel in balcony reports. time is 8:40. we have new details about a beach front that is ruffling

feathers in that neighborhood. >> allie rasmus is in san francisco with more information from the stores owner about that window display that some say is distasteful. >> reporter: this is the window display we're talking about. at first glance it looks like regular food cans stacked up. if you take a closer look at the labels they say things like colorful sky rat. boiled parrots. obviously we should point out these are not really cans of parrot. the owner of the store said by e-mail this morning that he created this display as a way to do something interesting before his store opened. the owner says he definitely did not expect this much attention or reaction from people. he put up this display a week ago. some people have found it more offensive than funny. as you can see from a letter from an angry neighbor, the owner put this letter up on his front door. the person writing it says the display is distasteful and says shame on you to the owner. other neighbors we talked to

around. half-moon bay is thick, thick, thick. highway 1 can be a little dicey. you can see it inch toward the sonoma and marin coast. might even come in there and touch it. southward it probably doesn't have much to work with today. really good looking low has produced snow. yeah snow up in the white mountains. a whopper of a system there continues to give new mexico, albuquerque and texas pretty good rainfall. our cool down starts with this system. just the leading edge of it on the coast today. 40s on a lot of the lows this morning. even 38 up in will willits. temperatures though starting to bounce up. alamo made it to 48 as well.
