Sharh Fiqh as-Sunnah Kitâb at-Tahârah #7
Dead animals that
have no running blood
Are they Tâhir(as
stated by the Ahnâf, the Mâlikiyyah, and some Shâfi’iyyah
and Hanâbilah)?
Or are they Najas
(as stated by some of the Shâfi’iyyah)?
Or are they Tâhir
if they come from something Tâhir and Najas if they come from
something Najas (as is the main opinion of the Hanâbilah)?
What do we say
about Al-Bukhârî’s Mu’allaq narrations?
Bones of dead animals.
Are they Tâhir
(as stated by the Ahnâf and Ibn Taymiyyah)?
Or do the bones
take the ruling of what the dead animal itself takes
(as is the main opinion of the Mâlikiyyah, Shâfi’iyyah and Hanâbilah)?
Or are they Harâm
to sell but permissible to use (as is the opinion
of Ibn Hazm)?
Or are the bones Najas
but purified through boiling them (as is the opinion
of some of the Mâlikiyyah)?
The fur, hair and feathers of the Maytah
If it is from a Tâhir
animal, while it is alive, then it is Tâhir according to Ijmâ’.
From dead animals
there are four opinions:
Are they Tâhir,
whether it is from a Tâhir or Najas animal
(as is the opinion of the Ahnâf, the Mâlikiyyah and a narration
from Imâm Ahmad, with the Ahnâf making an exception to pigs)?
Or does the hair
takes the ruling of the animal while alive; if it is Tâhir or Najas
(as is the main opinion of the Hanâbilah)?
Or are they all Najas,
except the human hair (as is the main opinion of the Shâfi’iyyah
and a narration from Ahmad)?
Or is it Najas
before tanning, Tâhir after it (as is the opinion
of Ibn Hazm)?
