state has appealed that ruling. the state filed an emergency appeal to keep him behind bars in a higher court. prosecuters argue dassey should stay in prison until his case is resolved in court...and the lower court did not have the authority to order dassey's release and by doing so would cause irreparable harm to the case. dassey's attorney argues the state has not made a case to keep him locked up. a judge has ordered dassey be released no later than 8 p-m tomorrow -- unless the 7th circuit of appeals rules otherwise. you can read o order of judge duffin -- when you visit fox6 now dot com or the fox6 news app. the story's on our home page. also -- search "avery archive" to check out developments in this story going back as far as 2003. west allis police are investigating a shooting at a cricket wireless store a customer was hurt. deandra corinthios is live from the police department with the details. we're told the customer suffered a gunshot wound and was being treated at a hospital for non life

anyone in custody. this happened at th e cricket wireless store at highway 100 and cleveland. west allis police set up a perimeter around the store they responded to the scene before 8 pm on wednesday other departments were also assisting ..including greenfield, new berlin and wauwatosa police as well as the milwaukee county sheriff's office. those who live nearby hope the person is arrested soon. 07:40 i saw some papers on ground, knocked over stool things with a number three so i thought it might be a shooting. again the customer who was shot...is expected to be okay. we're not sure if he or she has been released from the hospital at this point. police have not released any details about the suspect. reporting live in west allis deandra corinthios fox6 news milwaukee police also seeking two suspects in shootings from

police say a suspect got upset..and started shooting. a 48-year-old man was hit by those bullets...and drove himself to the hospital. and then around 2 a-m...a 22-year-old man showed up at the hospital with a gunshot wound. he told police he got in a fight with someone...who then got shot. both victims are expected to survive...and again police still looking for those responsible. 4 fire recruits are now officially milwaukee firefighters. the milwaukee fire department held a special graduation ceremony last night at the training academy weeks preparing physically and mentally. it was an extra special night for one of the recruits. his 93-year-old grandfather-- a world war two veteran-- pinned on his badge. "my grandfather's my hero. i wanted to grow up and be just like him since i was a little little guy, just like my boys and to have him here today meant the world to me." in the upper 60s. right now . when cold air returns next. vulgar-- offensive and tasteless--- thats what m-p-s officials are cali published in a local culture magazine. it mentions pregnancy and abortion -- while calling attention to students at bradley tech high school. kim is in the newsroom with more. the owner of sabbatic bar in walker's point tells fox6 the ad was designed to get the attention of m-p-s administrators. and it worked. it reads 'sabbatic is for lovers' and in bold print: 'our back alley: where 50- percent of bradley tech pregnancies start and end'. the man behind the ad says his bar has been a victim of many crimes and he

tech high school students. milwaukee police haven't been able to find a link between the school and the crime. still-- the owner says says m-p-s hasn't done enough to address the problem. 'these are words and i am not going to sit here and defend the first amendment. it was rude it was crass...' in a statement mps acknowledges the right to freedom of speech but they see the ad as vulgar and tasteless saying quote-- "we have a responsibility to speak out and stand up when false statements are made about our students. we will not stand degraded." they also say they are reaching out to the n-double-a-c-p and lulac to discuss the matter. new reports of prop money being used by customers in wisconsin. in green bay -- authorities investigating six instances where "movie prop money" was used at restaurants, gas stations and taverns. the prop money has the phrases "motion picture use only" stamped on both sides. it's not the first time these kinds of bills have been used in our area..

traffic check red on traffic map = major delays yellow on traffic map = some delays green on traffic map = no delays more than 200 people have been hospitalized with breathing difficulties in tennessee as wildfires scorch the southeast. authorities say over 30 large fires have burned more than 80-thousand acres in north and south carolina, georgia, tennessee, alabama and kentucky. crews are having a hard time battling the flames...as high conditions are driving the fires. due to air quality concerns -- some school districts in the carolinas are limiting outdoor physical activity. and low visibility due to smoke from those wildfires is believed to be a factor in a deadly crash in kentucky. a 65-year-old man was killed...and 14 cars were involved. multiple people were sent to the hospital. the stretch of road was closed for most of the day yesterday. triple-a is calling it the biggest thanksgiving rush in
