projections. governor branstad got right to business talking about the budget saying most of the state's money should go to education and medicaid. the newly sworn in speaker of the house, and first ever woman to hold the office in iowa agreed that it will be another tight budget year because state revenue isn't as high as many thought it would be. but she said there was a silver lining to the governor's speech. upmeyer 46:05 there werwe some things that appear to me to have a lot of bipartisan support so that's a great thing to see. one example of that bipartisan support came after the governor talked about the state's need to address equality within the criminal justice system. governor 29:27 in many cases, tax dollars may be better spent on rehabilitation than incarceration. ako 40:42 african americans are 33% of

jack/bam: other notables will be there tonight. the first lady has invited the c-e-o of microsoft to sit next to her. one topic president obama plans to discuss -- ramping up "stem" and computer science education, in an effort to put more americans in high-paying technology jobs. other guests of the first lady include: a homeless veterans advocate, a syrian refugee, connecticut governor dan malloy and spencer stone, the hero who thwarted a terror attack on a paris-bound train. stephanie/ram: some very surprising news on the presidential campaign trail today... a change-up at the top of the polls in iowa. according to the latest survey of iowa's likely democratic caucus-goers, bernie sanders is seeing a new surge of support. he's showing 49 percent of support, above hillary clinton's 44 percent support. that's outside the margin of error. marton o'malley polling 4- percent. compare that to just in mid- december when it was 51 percent for hillary, 40 percent for sanders.

another bit of good news for too... he got the endorsement of move-on, one of largest liberal groups. this endorsement did not come as a 80 percent of voted in favor of sanders. the group said it out 43-thousand in iowa and 30- hampshire to vote, volunteer, organize and fundraise. stephanie/ram with this new pressure to perform in iowa, hillary clinton ramped up her rhetoric on the campaign trail. in ames this morning, she got tough on senator sanders' stance on gun control. i find it kind of interesting whenever i say you know you voted against the brady bill five times you voted for what the nra said was the biggest nra priority giving them immunity and he says, we'll i'm from vermont. pat leahy the other senator from vermont voted against immunity for the gun lobby so no, that's not an explanation.

so what do iowans think of this democratic switch-up and what's the hillary campaign's strategy to reverse it? we'll go more in-depth on this issue tonight at six. stephanie/2shot: a typical winter-time problem is re- emerging once again. jack: it's a pothole pandemic! and today here at local five, we're on pothole patrol. jack: here's a big one right along valley west drive near valley west mall. it's just one of many you might have noticed making your ride a lot more bumpy lately. potholes are caused by the cycle of freezing and thawing of the road surface. it weakens the asphalt, leading to formation of cracks in the pavement. these areas then break apart with all the vehicle traffic, creating potholes. "when we have the freeze thaw cycle's that we've had lately that helps the potholes to form so we've had quite a few potholes espcially after this last round of colder weather " jack: we want to

iowa's most accurate forecast with chief meteorologist brad edwards. this is local 5 news at 5, we are iowa." jack/lam: today in court -- a civil lawsuit instead of criminal charges? it's a strange new development coming out of marion county. it was last june when 68 year old shirley carter was found dead of a gunshot wound in her home in lacona.

carter, has filed a wrongful death civil lawsuit against the couple's son, jason carter. the lawsuit names jason as her killer and seeks funeral expenses and compensation for pain and suffering. carter's body was found in the family's home back in june. she was shot with a rifle. we checked in with the marion county sheriff's office and state agents who say comment on this litigation. but when we last spoke to them about the investigation, they did not have enough evidence to charge anyone. stephanie/ots now to mexico and the latest on el chapo. once the most wanted international fugitive, now back in prison. today, as we learn more details about the dramatic raid and capture of the billionaire drug lord, rolling stone magazine released his full 17-minute interview with him and actor sean penn. here's abc's elizabeth hur with details. mode, to change an iphone or ipad screen light at night. jack: the company added the option based on a study that says exposure to blue light from screens in the evening can make it harder for you to fall asleep. night shift mode automatically shifts the colors on your iphone or ipad display to warmer colors, making things easier on your eyes at night. the system will use the clock and geolocation on your device to figure out when it's sunset where you are. in the morning it will return to its regular settings. stephanie/2couch: well no need for flyers and rewards-- there's a new way to handle the problem of a lost pet. jack: there's a new app out there called "finding rover." it's actually a facial recognition app. so once you download it, you can take a picture of your pet and it gets scanned into the system. if your dog gets lost, you can post that-- and the app will search through any new pictures posted to try to find a match. if you find a lost
