but then a surprise, the judge allowing flynn to delay his sentencing and continue his cooperation with the government. our pete williams has details. >> reporter: michael flynn arrived at the washington with every reason he would be sentenced only to probation with no prison time that's would be appropriate. and robert mueller's prosecutors agreed. saying he's been cooperating with them extensively. 19 separate meetings in the past year. but in a stunng ist, those hopes ran into a buzz saw named judge emmitt sullivan who said he couldn't de his disgust for what flynn admitted doing. >> flynn was smiling dung the earlier portion of the hearing, and he got a serious look on his face in a hurry. >> reporter: sullivan said it's a very serious offense for a senior government thofficial to lie t fbi and the white house, something flynn pleaded guilty to doing he's also admitted he did work as a paid lobbyist for the government of turkey without disclosing it. that was while he was acting as a foreign trump campaign.o the >> the next president of the united states.

>> reporter: judge y,ullivan said, arguaou sold your country out, and he even asked if mueller's prosecutors considered charging flynn with treason. the judge suggested if he went ahead with thse ntencing today, flynn would probably get prison time. after a recess, his lawyers tk the hint and formally asked the judge to postpone the sentencing. >> i think it's possible dge gave flynn a little bit of a break today. if he had imposed nt ence today, he may have given flynn some prison time. >> reporter: in an tweet, orni president trump wished flynn good luck at the sentencing. this afternoon, the white hoid whatever crimes flynn comm ted he did them on his own. >> maybe he dido those things. but that doesn't have anything to do with the president >> reporter: flynn's best prison time is continuing to cooperate with prosecutors before he comes back for another hearing. nghe judge set a new hearor march 13th, and flynn remains out on bail.

now the question, can he enough in the next three months to convince the judge that he does not deserve prison time? lester? >> pete williams, thank you. d it was announ that president trump's charitable foundation will shut down as a result of aawsuit alleging that president trp used it to promote his businesses and campaign. here's nbc's hallie jackson. >> reporter: donald trump's charity acted more like a checkbook for his campaign according to the new york attorney general, who announced an agreement today with the presids attorney to dissolve the controversial trump foundation. barbara underwood blasting a ocking pattern of illegality. the foundation, she hargues, used top the president politically. the lawsuit points to 2016 appearances like this one. >> we just cracked $6 million. rt >> e giving out donations to veterans right before the iowa caucuses. is "washington post" investigation revealed other donations benefited the trumps. the biggest one helped restore a fountain outside otrump hotel in 1989.

here's miguel almaguer. >> reporter: for new mom, ellen rigney, baby topperas her favorite show. dad nathan called it her cctv. nest cam on the ipad over there so i could see him from every angle. >> reporter: so they were terrified to hear a man's voice caught on their nest cam coming from the baby's nursery. >> we heard sexual expletives being said in his room. he turned that camera on and told us, i'm y going to kidnr baby, i'm in your baby's room. >> reporter: they raced to the room to find topper alone, sleeping soundly. they had been hacked. and they're not the only ones. this family in texas says a stranger spoke to their nanny through the baby cam. security experts warn wi-fi baby monitors are vulnerae to online intruders. they filed a police report, but the hacker will likely never be found. nest is blaming the hack on poor password teecurity and alerting affeconsumers to reset their passwords

there is video out of houston tonight capturing a disturbing hit and run accident. the man who was allegedly behind the wheel is a police officer. nbc's kerry sanders has the story. it >> reporter the shocking incident caught on camera, a police patrol car from a local schoo district, hits a homeless woman crossing a housto street and leaves the scene. behind the wheel police say off duty independent school district officer omario gothright. on t e ground, alison moon. she told our houston
