new this morning, a philadelphia officer is lucky to be alive after a gunman walked up to his cruiser and shot him several times. he took three bullets in his left arm. that arm is broken, and also has nerve damage. despite that, he's expected to recover. investigators say it happened just before midnight. they say the gunman got so close he was actually firing from inside the car window. 1:15 - 1:25 commissioner richard ross/philadelphia this guy tried to execute the police officer. the police officer had no idea he was coming. uh... it's amazing he's alive." 33-year-old officer jesse hartnett returned fire, hitting the suspect. officers later caught the 30-year- old gunman. investigators are still trying to figure out a motive. the fate of former governor bob mcdonnell

the u-s supreme court today. for the frst time since a jury convicted mcdonnell on 11 federal corruption counts, the high court may consider hearing his corruption appeal. rico bush has more on what's happening today. rico, walk us through what's next for the former governor? don, today is the first conference day for the high court. justices are scheduled to sit down and review what cases to hear or deny. if they agree to put the former governor's corruption case on the docket, oral arguments could start before june. if the court denies mcdonnell's petition, he will be forced to go to prison to serve out his two-year sentence. in september 20-14, a federal jury found mcdonnell guilty of corruption. jurors found the former governor and his wife maureen, traded political favors for gifts and loans from a wealthy businessman for special treatment. since his conviction, his legal team has appealed the verdict at every stage and exhausted all other legal options. the high court now has the final say on the matter. mcdonnell's defense team believes federal

former governor on a broad definition of corruption and wants the justices to overturn his conviction. it'll take at least four votes to hear his case. and on monday, we could find out if the high court will take up mcdonnell's appeal. rico bush, 10 on your side. today marks five years since a gunman killed six people outside a tucson, arizona strip mall. a nine-year-old girl died in the shooting, and congresswoman gabby giffords was severly injured. she was speaking to constituents when 22-year-old jared loughner opened fire. also happening today, the white house is sending national security officials to silcon valley. they will meet with top companies in the tech industry about how to disrupt isis and other terrorist groups. some officials expected in today's meeting are attorney general loretta lynch, f-b-i director james comey, and national intelligence director james clapper. one passenger on board this flight, had a really bad day. why officers literally carried her off a plane

her son ethan escape the country. she arrived at a north texas jail yesterday after police arrested her in mexico last week. they're holding her on a one-million dollars bond. ethan is still in a holding facility in mexico city. also happening today, a slight rebound in chinese stocks. despite the gain, people will still be keeping a close eye on the world market. reuters reports the gain is unlikely to improve sentiment in the european markets. china's stock market sank about 7 percent thursday. the country's currency fell to its lowest level against the dollar in almost 5 years. trading was automatically suspended. the shutdown set off a slump in other stocks across the globe. so far, japan's market is up. wall street opens at 9:30 this morning. for most of the week we've been telling you about several armed robberies at convenience stores. and now virginia beach police are searching for a suspect. they say the robber stabbed a worker at a citgo station on diamond springs road

this is the second time in a week the store was robbed. police are looking to see if the two crimes are connected. customers are now starting to think differently about convenience stores. melissa reid, customer "when you just run into the store get a pack a cigarettes a soda or whatever you don't think my life could be in jeopardy. it's not something that crosses your mind. " "how are you something like that? i don't know i can't understand it." the suspect stabbed the employee in the arm. police say she should be okay. then the robber ran behind the convenience store towards the driftwood apartments. if you have any information that can help police, call the crime line. several of those other convenience store robberies happened at 7-elevens all over hampton roads. police identified a suspect in one on wednesday morning. we were the first to show you this surveillance video from inside the store on chesapeake boulevard. officers believe the man who shot the clerk is 38-year-old kevin bristow. if you've seen him, or know where he is,

an update about the injured clerk. we're told he is now out of the hospital. the chesapeake boulevard 7-eleven was robbed twice this week. someone hit it wednesday night. along with two other locations in ghent, all within an hour. police are not saying any of the robberies are connected. after this rash of robberies we contacted 7-eleven about store safety. the company released this statement: "every 7-eleven store in the united states is equipped with security surveillance cameras so we can improve the safety of our guests, store employees and franchisees, and aid law enforcement officials in their pursuit of criminals." the company also said it has safeguards in place including: keeping cash levels low, upgrading lighting and security systems at stores, and issuing employees safety devices. new this morning, a village in new york may finally get the chance to change its very controversial seal. officials in whitesboro have wanted to change it for years. take a look. village

dates back to 18-83 and shows the founder - hugh white - in a so-called "friendly" wrestling match with the local indigenous people. official say the seal is supposed to show how the founder gained respect from them. on monday, the village will finally get to vote on a replacement image. :17 - :25 mayor patrick have the say about what seal they want to represent them and their home and they're history." whitesboro's mayor says the vote on a new seal is not legally binding. voters are expected to cast their votes monday night. now to a controversial device that more than a dozen colleges across the country refuse to let on their campuses. 20 colleges and universities are banning hoverboards because they can seriously hurt the rider or catch fire. so far we haven't heard of any schools in hampton roads that are banning them. there are a few schools in northern virginia and washington, d-c banning them including

and george washington universities. new this morning, an unruly passenger forced a plane to make an emergency landing. then officers tied her up and literally carried her off the plane. passengers applauded the officers as they took her out. airline officials said she assaulted several passengers shortly after the plane took off. police say she may have been suffering from a medical condition. good morning, hampton roads. let's check

first conference day, where justices decide on which cases to review and which ones to deny. rico bush is live in our newsroom with more on what's expected to happen today. rico, good morning. good morning brandi, for the first time since mcdonnell's conviction, the high court may consider hearing the former governor's appeal. it will take at least four justices to decide if they want to review the case. in september 20-14, a federal jury convicted mcdonnell on 11 federal corruption counts. and, last year a federal judge sentenced mcdonnell to two years in prison. a jury found him and his wife, maureen, guilty of trading political favors for gifts and loans from a wealthy businessman. his legal team immediately appealed the conviction and pleaded his case all the way up to the u-s supreme court. mcdonnell's attorney's argued the former governor was convicted based on a broad definition of corruption that puts all elected officials at risk of prosecution. if the justices agree to put his corruption case on the docket, oral arguments

apartment fire. our affiliate in the area says a back stairwell of the building collapsed, and at least two people went to the hospital. earlier intense flames were shooting out of the building, but now firefighers seem to have a little bit more control of it. we are working to show we'll keep monitoring this and bring you more available. this morning, a stand-out college athlete is fighting for her life. 20-year-old amber brown plays basketball at norfolk state university. someone found her unconscious in her dorm room new year's day. family members believe her condition may be related to diabetes. they're asking for your prayers and support. c1 ebony brown - amber's older sister 01:03:46 "it's been tough i mean i have to say this has been the toughest days that i've ever encountered before, i don't think i ever imagined anything happening like this so

tough." runs :16 amber's hospital bills are mounting. the family has an on-line site where can help. just head to wavy-dot-com to find that information. investigators say they'll try to recover the truck that went over the side of the cbbt, on saturday. only chopper 10 could show you the scene from above, moments after the truck went over the side. investigators say the driver, 33-year-old matthew killmon, drove through the barricade and into the chesapeake bay. amazingly, he had only minor injuries when crews pulled him from the water. he somehow managed to get out of the cab and swim to the surface. the salvage company will try to recover the truck if the weather permits. thieves are stealing expensive air conditioning units in hampton. police say crooks stole nine a/c compressors in two incidents in the last week. this is the damage from the riverdale office park, off cunningham drive. experts say the thieves

mcdonnell's conviction, the high court may consider hearing the former governor's appeal. it will take at least four justices to decide if they want to review the case. in september 20-14, a federal jury convicted mcdonnell on 11 federal corruption counts. and, last year a federal judge sentenced mcdonnell to two years in prison. a jury found him and his wife, maureen, guilty of trading political favors for gifts and loans from a wealthy businessman. his legal team immediately appealed the conviction and pleaded his case all the way up to the u-s supreme court. mcdonnell's attorney's argued the former governor was convicted based on a broad definition of corruption that puts all elected officials at risk of prosecution. if the justices agree to put his corruption case on the docket, oral arguments could be held before june. if the court denies mcdonnell's petition, he would forced to go to prison to serve out his sentence. it's unlikely the supreme court will announce today if they will hear the

but we could find out on monday, when the high court issues orders for 20-16. live in the newsroom, rico bush, 10 on your side. we have new information about that breaking news happening right now in kansas city, missouri. we just got this video of firefighters are battling a big apartment fire. our affiliate in the area just said crews had to move people back because of concerns the front of the building may collapse. the back of the building has already collapsed, and at least two people went to the hospital. firefighters had to evacuate the apartment in the middle of fighting this fire. the fire started a little after 5 this morning. some residents ran out of the building without shoes. one couple jumped out of the buidling to get to safety. all new this morning, we can show you the scene in virginia beach where a home caught fire, killing a cat and displacing a family of 5. two of the five displaced family members are children.

minor injuries when crews pulled him from the water. he somehow managed to get out of the cab and swim to the surface. the salvage company will try to recover the truck if the weather permits. this morning, we're on your side with news of a big furniture recall you need to know about. office depot is recalling about 300- thousand of these crawley brand executive style chairs because people have fallen out of them. there have been at least 8 reports of the seat have one of these chairs or use one at work, you should contact office depot for a replacement seat kit. wegmans is recalling some of its chicken products. the grocery store says more than a thousand pounds of these chicken breast cutlets were not checked by federal inspectors before being packaged up. this recall does impact stores in virginia. so far, there have been no reports of anyone getting sick from this product. local economic leaders say they will make an

we go!! the new mom and her husband were speeding on the way to the hospital. that's when troopers pulled them over. the woman was already in labor in the back seat. an ambulance showed up and took mom and the baby girl to the hospital. this morning, everyone is doing well. also caught on tape, crews rescued a man who wound up in a garbage truck. check out this video from chico, california, just north of sacramento. the fire department says the man got stuck in the truck's trash compactor. officers say he was sleeping in a dumpster. the truck arrived to pick-up the trash, and the man got caught up in it. this morning, the man is recovering at the hospital. investigators have not said how he's doing. he's very lucky considering the driver runs the compactor after
