this developing story for us.lillian? >> both men had been on the platform, so it's unclear how and why they ended up on the railroad tracks. the train that hit them was an express train that was not scheduled to stop here, it was traveling upwards of 50 miles per hour. this is how fast the train was going before it hit two men at the santa clara station. one man died from the impact, the other is being treated for multiple fractures to his legs. dave ashley was on the platform at the time waiting for his train. >> the train came by, there was something of an unusual sound. you hear it, you go, oh. >> the circumstances of this incident are unusual, because it involves two people. >> usually 90% of them are suicides, usually they're only involving one person. this appears to be something that will require further investigation. >> investigators will look at video from cameras mounted on the train, and they hope to interview the surviving victim. the passengers dealt with the delays as best police commission. >> the evidence is just sitting unprocessed because apparently in san francisco you know the crime of rape is not considered that serious. >> after our report, the sfpd promised a surveillance video. they say shultz reached for the man on the tracks and then both were hit by an express train. shultz died on the tracks. the other victim remains in the hospital with multiple fractures and he is not yet able to speak with investigators. >>> students are on alert after a student says he was taken from campus and sexually assaulted. this happened at the college of marin in kentfield. abc news anchor a a ma dates joins us with the latest. ama? >> the students said it happened in this parking lot. it is well lit tonight, but last night, nothing but dark mess. the college of marin has extra police officers patrolling parking lot 13. the added security is in response to a kidnapping and sexual assault that began in the lot around 8:00 last night. >> that's horrible. that's pretty scary. >> students were notified through e-mail, text alerts and even a facebook post. the victim, a male student says when he got in his car after class there was a man with a gun in the backseat who forced him to drive to the valley where the man sexually assaulted him. the student was able to escape and get help and the attacker escaped. he is described as a black male 6 feet to 6 foot 2 and wearing wearing -- weighing 225 pounds. >> somebody who would do this is a sick person. >> this student who didn't want to be identified saw police putting up these alert notices around campus. >> i will be getting a parking permit so i can park closer to campus. >> she often uses lot 13 at night. >> generally it is pretty empty, the parking lot. a lot of students have left. >> the vice president of college operations says lot 13 is a temporary lot the school has had for a number of years. >> it is a gravel parking lot that is used and a free parking lot we use for students as changes at san francisco general hospital after a patient was found dead in the stairwell. in september she disappeared from her room, but her body wasn't found until two and a half weeks later in a out toward the bay, visibility is good. dropped to the mid40s in oakland and 51 in san jose and it is 46 in half moon bay. as we look from the exploratorium camera, it is a beautiful view from the financial district in san francisco. 41 right now in santa rosa and napa. it is not too cold because the clouds kept us insulated. same thing for livermore. and one last view from the camera, the wind has really dialed back, especially over the hilltops. mild to warm for the upcoming weekend. a spare the air alert was issued for your saturday and there are signs of change late next week. i stall here because the computer models are consistently showing potential for a major shift in our weather as we head toward the end of january and the mid-february. they drew up the high level clouds. and that is going to continue to pull up the cloudiness. not expecting rain. here is a look at the computer animation. you can see the filtered sunshine due to the clouds out there. the temperatures are still unseasonably mild to warm for this time of year. as you look at the overnight readings, not too cold. those clouds would keep your numbers up, 37 in napa and those will be the coldest locations. 37 livermore and low 40s around palo alto and san jose and 48 san francisco and 45 for you in oakland. and for your highs on saturday it is going to be mild. 72 los gatos. occasional high clouds filtering the sun on the peninsula. 71 redwood city and 67 in half moon bay. downtown san francisco, south san francisco in the upper 60s. these temperatures definitely not winter like. it is more like what you would see in the springtime. north bay 72 santa rosa. 71 in novato. east bay communities if you are taking the dog out for a walk, take your kids to the park, nice weather. 70 in oakland and inland spots, 72 in walnut creek. livermore, pretty mild to warm for your saturday. sunday slight dip in the numbers. patchy fog may be returning and the temperatures will come down on monday. a nice recovery and i know we need the rain, but it is going to be near or at record levels as we head toward your tuesday, wednesday time period. thursday is starting to see the clouds coming in and phenomenal guy in every sense of the word. >> we are hearing that a lot tonight. i'm dan ashley. >> i'm carolyn johnson. we have live team coverage on this breaking story tonight. we will start with alan wang. >> alan, you have been learning more about the moments leading up to this tragedy. >> yes, we are also learning more about the investigator who was killed and the investigator who accidentally shot him. it was about five -- 15 minutes ago detectives wrapped up a solemn investigation that happened in an apartment behind these gates. about 4:00 four officers came to the park sierra apartments to search the unit of a suspect accused of robbing passengers on bart trains. >> were you ever concerned about who your neighbors are? >> not in dublin. >> my understanding is they knocked on the door and there was no answer. when they turned the knob it was unlocked. they felt somebody was in the home since the door was unlocked. >> they went in this their guns drawn and that's when the officer accidentally shot and killed sergeant tom smith. we are told he was likely hit under his arm where there is no protection from his bullet proof vest. this is video of smith last year. he was in command of the bart investigative unit and supervised the officer who accidentally shot him. the officer who fired the shot has more than 10 years on the force. >> you have to understand how devastated he is at this point. this was certainly not his intent and you can only imagine the heartbreak that officer has at this time. >> turns out there was no one in the apartment and now detectives are trying to figure out how and why the gun went off. smith is the first bart officer to die in the line of duty. sergeant tom smith was the lead investigator in the bart -- the on is -- the oscar grant case and the officer who shot him helped investigate. bart does not conduct these searches as often as other departments, but when it does the lead investigator likes to be involved and that's why sergeant smith was out here today. reporting live in dublin, alan wang, abc7 news. >> thank you. it is of course a somber scene in san ramon where they stopped by the home of sergeant smith and his wife and daughter and pay their respects. john alston spoke with neighbors. >> the procession was short and powerful as the body of sergeant tom smith was moved out of eden medical center in castro valley. to collect themselves fellow officers and a chaplain gathered for an i'm impromptu prayer circle. it not only devastated the police community but the san ramon neighborhood where he lived with his wife, kelly who is also a bart police officer. they have a young daughter. >> a phenomenal, phenomenal guy in every sense of the word. a family man. he has a young daughter, wife. both husband and wife are both officers for bart. >> he remembers smith playing with his daughter in front of their home and walking his police dog. shaw saw his neighbor just this morning. >> i heard it on the radio on the way here that a bart police woulds -- got shot today by accident. the first thing i thought about was tom and his wife kelly. they are both bart police officers and i figure they must know what happened. >> then the worst possible news. >> it is with heavy heart i have to announce the tragic loss of the first officer killed in the line of duty in the history of the bart police department. >> just devastated. we are just devastated. >> a short time ago one of sergeant smith's brother who is also a police officer stopped by and wanted to tell me that his brother was a phenomenal guy. he also wants people to remember that there is another family in pain tonight and an officer, the bart colleague, who fired the facial shot. abc7 news. >> john, thank you. >> bart's police force had a sear reeves reforms in the shooting death of oscar grant by a bart officer. just last month an independent uh -- auditor says they had a majority of the reforms including the twitter at abc7 news bay area. >>> we have more breaking news. for the second time today chp officers shot a suspect in oakland after a chase. it happened at 9:00 on wentworth and bancroft. the man tried to run and then turned and opened fire on the officer. a chp dog was also hurt in the shooting. officers shot and killed another man around 3:00 this morning after a high speed chase on 580 and it ended in a crash. they say they approached the chp officer with a firearm in his hand. >>> pacifica police believe a man was drunk when he drove his truck off a cliff this afternoon. sky 7hd shows you where the pick uplanded on the hillside below manor drive. firefighters repelled down to the truck. a highway patrol helicopter hoisted the driver from the cliff. officers cited him for dui after he was treated for minor injuries at a hospital. >>> and a couple had to be rescued from their fishing boat after a they passed out from carbon ma monoxide poisoning. they were fishing when the wife lost consciousness. he called authorities and then he passed out. a coast guard crew found them and gave them oxygen. authorities say the quick response may have saved their lives. >>> tech company's private buses can use muni bus stops in san francisco. after a packed meeting the san diego municipal transportation agency unanimously approved an 18-month pilot program. it allows the use of200 of muni 's bus stops for $100 stop per bus. opponents are upset and they told us it symbolizes the growing income divide in the city. they want the city to charge more than $1 a bus. but state law only allows the city to cover the cost of implementing the new regulation. >> $1? give me a break. that's criminal. >> it is paying for enforcement. it is paying for the establishment of the program. there will be decals. r. >> hospitals hospitals and university buses will be allowed to use the bus stops. >> you know we need the rain desperately and here is how badly. they approved restrictions to help
