you know, bill cosby. bill cosby. i went to the hilton, he said that someone from the agency was going to meet me. took a couple of snapshots of me and they had left and i was having really bad allergies and he said, "here, this is an antihistamine," and it was a blue pill, and he gave it to me with a shot of amaretto. you know, he said, "it'll make you feel better." pretty soon i got to feeling kind of disoriented and it's like i couldn't move my body. and i was like -- like, kind of catatonic. he began pinching on my breasts and he was grunting. and i kept saying to myself, "dr. huxtable -- dr. huxtable," and i remember something warm up my leg and i -- and i was passed out and i woke up to him saying, "daddy said, wake up, daddy said, wake up." put about $1,500 on the dresser. i thought i was going to be on "the cosby show," i thought he was going to help me. and he didn't help me, he hurt me. he made me feel like nobody. i felt like nothing. who's going to believe me? i'm just a high school student. >> reporter: l

cosby. he will have to defend himself in trial. this is the first time this has ever happened. what happens next? well, with his judge's ruling, they move towards to an arraignment process july 20th. his lawyer will learn based on what they saw today and what preparations moving forward and how they want the case. the end of the proceedings there, we heard an aggressive case made by bill cosby's council. al case they lost at this round arguing the accuser was not reliable but this is all consensual contact. the judge said no, there is enough evidence to proceed, it will be a criminal trial for bill cosby for these allegations of sex crimes. his lawyer has maintained his innocence in this and as in many other cases that involves in this type of accusations. >> based on what we have heard today, how much of a surprise to you? >> this is not a surprise, the paper record up to this point involving series and precise and allegations of misconduct. the prosecutors argued and closed the circle on w

this is another big part of the cosby defense. if you were sexually abused or if an aggravated sexual assault on you occurred, would you continue to go to the home of the man who had assaulted you? so there's going to be a real attack on her credibility during the course of this entire trial, and we're getting a little bit of a taste of it now. >> so, okay, so her credibility will clearly be a focus for the defense, but what about all these other women, more than 50-plus now have come forward to accuse bill cosby of sexual assault or rape. how will that play into all of this? >> well, the first question is, does it get into court in this trial? and if you have prior crimes that you've committed, generally that's not admissible in a criminal prosecution. now, the reason for that is that when we hear that somebody did something before, you immediately make up your mind, they must be guilty, and the court system has always had this idea that we're just looking at the facts of an individual case. however, there's an exception to this

cosby's key accuser. >> we last saw cosby in court for a pretrial hearing in february. cosby age 78 has been working to get his criminal case thrown out since being charged in december. on monday the state supreme court refused lawyer's 11 hour appeal to delay today's hearing and he returns as court determines if prosecutors have enough evidence for trial. and speculation is building that cosby's accuser andrea constan could be called as prosecution witness. back in 2006 constan took undisclosed financial settlement in civil suit against cosby coming by way of cosby's testimony which lawyers say he gave with assurance it would be sealed. never revealed. >> former mnt coda bruce castor admitted to making so-called deal and federal judge later unsealed testimony prompting current da kevin steel to pursue this criminal case arguing that deal was not bipding to his office. cosby up sealed deposition details he has given women drugs before for sex and constan ales that happened to her in 2004 when she was a temple basketball staffer and considered cosby a mentor. cosby insis

and that is cosby's consent. and that is this. in the deposition, bill cosby was asked when you got the quaaludes, was it in your mind that you were going to use these quaaludes for young women that you wanted to have sex with and the answer was yes. does that meet an extremely light burden to go to trial? >> reporter: let's talk about the issue of consent. we need to point out the viewers the following. there are three counts here and one is predicated upon lack of consent. there are two other counts and one relating to her being unconscious at the time because of pills and because of quaaludes or some other types of substance and therefore not having the ability to consent. the other relates to specifically drugging her, thereby knowing she was in a position where she couldn't consent. those are three theories. this is the larger picture and i should point out after these preliminary hearings as danny cevallos points out quite rightly, since it's a low standard, i very much expect this case will move forward to trial. this case

cosby, but show motive, there was plan. there was intent for this kind of exact conduct alleged here. it has to be close in time. it has to be similar in actions. if that kind of emotion is made, that's going to be a trial within the trial, and that's going to go a very long way in the determination, i think, at the end on what's ultimately going to happen in this case. that is what happens from the state's perspective at this point moving forward. >> that's the prosecutors. what's next for the defense, judge? >> well, the defense, obviously, can make different motions to the court to excertain parts of evidence. prior to position testimony, i'm sure that's subject to a motion. any othering statements that mr. cosby made probably also they'll file motions to suppress that. they will file what we call emotions to limit testimony that comes out in the case. all these pretrial motions shape the case, and that's really where all the activity takes place. the case, the trial usually goes very smoothly because all of these other
