no one watches the numbers more closely than karl rove. karl joins us. karl, am i i right? it's the undecides tonight who everyone is trying to hustle? >> well, everybody is trying to hustle the undecides because that's where most of the play is available still in the election you are right if you have got momentum undecided voters moving in your direction. >> some republican or democrat in the next few days say look i have always been a a republican or democrat. the last four days, i have suddenly decided i'm going to switch parties. aren't people pretty much entrenched at this point? >> well, they are pretty well entrenched remember even in successful election. you will get 90% plus of each party will get 90% plus of partisans but lose a small number of partisans to the other side. frankly sometimes that's the measure of the margin between the two campaigns. you are right, look, what's this is going to come down to at the send in very close races, some that are pretty well settled. montana south dakota, west virginia for example, republicans lead by double digits. but in

karl, it's awfully close. why do you think it's going to go gop? >> first of all, the fact that she came through a bitter primary and has united the party is one thing. secondly, in iowa they've had a terrific ground game historically. in 2010, at this point they had 27,759 early ballots -- an advantage in early ballots requested. today it is 21,924. at this point in 2010, they had a 22,352 advantage in returned ballots. this year they have under 12,000. cut almost in half. 2010, remember, is a year where they lose the governor's race 54/43 and lose the senate race 64/33, so they were doing worse than in 2010. >> let's tern to another one of the very close races, that's where colorado where cory gardner is barely ahead, just 1.3 points, barely ahead of the democratic incumbent senator mar udahl. joe, udahl has made this one so much about women's issues that some people in colorado are calling mark udall senator uterus. will that work? >> that may work for him this is another race -- the thing with gardner is you have a member of congress running ag

we see groups like karl rove's american crossroads has a superpack -- superpac that reveals how much money and where they get it from and all of their spending. and then they have another arm that is an educational arm. voter educational arm. and that is classified sort of as a charity. and they don't have to release their donors. we don't know how much money is in there. we do learn how much they spend. we don't know how much they raise or from whom. so there is some dark money out there. but what we've also seen this cycle is once again, more of the billionaires stepping into the political environment. and playing. you know, and many of them are playing on issues. but a few weeks ago, we saw alarms being set, turned on by many republicans. because the superpacs that republicans had always dominated were actually being outspent. and in part that's because you look at the biggest billionaires in the game, the top three, are democrats. led by tom stire who has legend to spend $50 million of his own and well on the way. he's already spent $42 million. >> jeanne, one of the things that

", what's his position in this. >> in the '90s, in texas and alabama, karl rove pushed the courts in a conservative direction, bringing a republican takeover of the courts. in the '90s. in 2000 there was a greater expansion, tort wars became the court wars, and more and more states were politicized, and had different special interest groups putting money into them. >> he's innovative, if nothing else. a lot of this is supported by business interests, conservative business interests. the attack ads don't generally speak about the interests. they talk about being soft on crime. once a certain amount of money is flowing into a race, judges save their money, being tough on crime. >> that's right. there's academic studies suggesting that judges change their behaviour. in election years, if you look at the sentencing decisions. they tend to be harder on crime. judges raised the alarm about the pressures that these attack adds and fundraising are putting on them. most judge don't want to play the role. they feel they have no choice. >> there was a case in west virginia where the c ex o paid

i say, look at karl rove -- in crossroads. why did i name him? they were the biggest and most active. i said, look at all the group, right and left. the ruling gave secrecy to campaign contributions at a time when most of us support disclosure. >> could you explain how the alec situation is different from organized labor? >> you really don't know who organized labor is? >> you don't have to disclose your members. do you not think any democrat -- >> they are now. it ought to stop on both sides. if i asked the corporate supporters of alec to give us the names of all their stockholders, ridiculous. i think it' whatponsible to say, corporation is supporting the organization lobbying for the passage of standard ground laws in florida? why is there such an outlandish request? >> senator durbin has gone through so many things, it's hard to go back and catch up. but george soros has spent large sums of money on the other side of the coin. this is a clear case of intimidation. in the case of alec, they don't generally support stand your ground -- i'm sure
