shaleem tindle sister and brothers were at this rally, where a photo was shown of kendall's back after he was shot by a police officer last month. he was involved in the scuffle with another man across from the west oakland station. a bart officer responded to a report of shots fired, and one of the men was found shot in the lake. police say that shaleem tindle was armed when he was shot by the officer, and a gun was found at the scene. but the body camera video shows shaleem tindle breaking apart from the fight with his back to the officer. john burris said he did not have a weapon. >> his hands were coming up, and he gets shot and falls back on the ground like this, and nothing was in his hand. and john burris has filed a claim against the police department and officer joseph mateu who opened fire. >> we want to see officer joseph mateu charge! >> reporter: we sat down with the bart police chief late tuesday afternoon. >> nothing will be done until that investigation takes his course, and we will continue to get the facts and it is really in the court of the oakland police department
