let's bring in cnn legal analyst paul cullen, mel robbins with us as well. good morning to both of you. >> good morning. >> good morning. he was a freshman, at that age, would he have been permitted to use this kind of gun? the report is he's 14 years old. >> well, in many jurisdictions, even at that age, you're allowed to go to a range and fire a weapon under adult supervision. so it is possible he could have developed familiarity with how to use a weapon of that kind. but to have it in school or on the street is quite a different matter. >> mel, is there any liability here for the father? >> well, there's two different aspects to discuss, victor, and it's a terrific question, because, you know, as we've reported that sources are saying it's being traced back to his father. i doubt very highly there would be any kind of criminal liability in this case for the father, victor, but perhaps there could be some sort of negligence charge brought in a civil lawsuit for wrongful death or injuries from the other students who were hit, if the father, for example, wer

let's talk about all of this with cnn contributor and legal analyst mel robbins and liz brown, columnist. liz, i want to start with you and this new report in "the washington post," which is staggering, to learn that seven or eight they say african-american witnesses have come forward to the grand jury and said that they are corroborating and supporting officer wilson's account. what do we know about this, liz? >> well, what we know about it is, has to be framed in terms of how this entire grand jury has been prosecuted, how the grand jury has been put together and what information that we've been given. the fact that we know anything at all about any of those witnesses is astounding, because of, that this information is being leaked. so do we trust that the same entity, the same person, the same prosecutor, bob mccullough, do we trust that this person is being fair and impartial with this case, and this is a very calculated thing to get to, very calculated bit of information to say that witnesses corroborate darren wilson's testimony, and that it'sic calculated to say ty are african-ame

mel robbins is our legal analyst. mel, you look at this man's past, a convicted sex offender, convicted of aggravated rape in 2009 and he served five years for that. that doesn't seem like a long sentence. this seems like a guy you would keep on a very short leash. >> oh, a very short leash, indeed, john and michaela. this is such a gruesome story. i dent even know where to begin. but let's start with that case in texas. so in 2007 he hired a prostitute and when she arrived he asked her if she was a police officer and as soon as she said no he immediately started the assault, the strangulation, the rain, and she was one of perhaps only the lucky ones who had an encounter with him because she left. she cooperated with the police guys, told them the whole story, he was arrested in 2009, pled guilty, sentenced to five years, did the entire time and when he was released from a jail in austin, texas, he was deemed by the state of texas as "a low risk." he did register when he moved back to indiana, but obviously since they

let's bring in mel robbins, cnn local commentator and legal analyst, lawrence koefl inchesky. let's talk about what we have and don't have. mel, i'll start with you, the case of the woman who survived, thank god, the victim of the rape and assault, attempted murder there. how did they get do that point? what must they have learned from the woman about that? where does that make the situation lie for you? >> hey, good morning, chris, good morning, larry. this is a terrific development. and the reason why it's terrific is we now have case, chris, with a victim who is alive, police have spoken to and who is willing to testify. so what you're going to see, they're going to bring charges in fairfax county. and they absolutely with dna evidence and a victim, will be able to convict him. that way, he will be a convicted rapist and a convicted guy with an attempted murder charge when they bring him on charges against harrington and hannah graham. >> what did she have to tell them, mel, that gets them to an attempted murder charge and not just rape? >> well, perhaps that he threatened

i'm joined by mel robbins and larry kablinsky, one of the best in the business when it comes to the notion of forensics and how critical they are, from the collection moment, not just a presentation in the courtroom but the preservation of how you get this evidence. can you walk me through what they are doing in that dirt at this moment? >> well, they are sifting the soil looking for any trace evidence that might help them establish a link between a suspect and a victim. they will be looking for a weapon perhaps or hair. anything that they can use to identify whoever did this. they did find black pants and that's significant. because if she had been sexually assaulted, there's a possibility semen will be found on the pants and because of the nature of the dna molecule, it should still be in tact despite 35 days. >> doctor, i have covered enough cases with you where we have seen this thing play out why someone who has brought in on a murder, where dna or fibers or hair of that suspect are found on the body and they have a defense, i was with her but i didn't kill her. in this respect, how c

joining me now cnn commentator and legal analyst mel robbins. mel, as you look at this, and this is america, right so, there's always the chance of someone suing for something, as you and i both well know, but when you look at all the companies now involved here, you've got a hospital in texas that seemed to make some mistakes, an airline, a cruise liner, even have the cdc, right, who arguably made some mistakes. are they vulnerable to lawsuits that could be very expensive? >> well, jim, you asked the question with a nod toward i think the first issue that we need to talk about, which is anybody can sue anyone for anything. the question is whether or not these cases will be successful. so why don't we kind of break them down one at a time. how about that? >> sounds great. let's start with, say, a hospital, texas presbyterian, they treated this patient and you'd have to think the strongest claim is the fam hi of thomas eric duncan, he came in, they turned him away, he came back, he was sick, he died. do they have a likely legal claim that could b

back with me now, cnn legal analyst mel robbins. why bring up this charge and this arrest warrant now? >> there's two reasons. the one reason is if you notice once they tasered him they also arrested him and so now he's in the system and he's fingerpri fingerprinted and what happens in that instance is old arrest warrants come up. so on one hand, you've got a criminal procedure that was ignited with the arrest and typically warrants come up. on the other hand, this thing is seven years old. they didn't raise it or issue an arrest warrant until after he filed his lawsuit. i don't think it takes a rocket scientist to say that the hammond police are trying to send a message to this guy and the whole thing stinks. >> is it common place that someone who is put in the spotlight for something else and all of a sudden this sort of thing happens? >> that's not very commonplace at all because it looks badly on the police. if you're going to arrest him for failure to obey an officer and refusing to give identification and for disorderly conduc

mel robbins and mark geragos back on this one. where do i even begin? the criminal or -- >> he stopped talking and if you're advising him, it's a good thing. mel can tell you but there's not much that can be done. it's a misdemeanor. >> it's a misdemeanor. we looked into this, mark and i did. >> intentionally infecting somebody. >> it's not necessarily a death sentence but what is so stunning, there are 35 states in the u.s. that have criminalized the sexual transmission of diseases, knowingly doing it and 34 make it a felony to transmit hiv to somebody and alabama it's only a misdemeanor. this guy is facing a class c misdemeanor. >> if you can't find remedy in the criminal justice system, you go with the civil justice system. that's a lot of liability here. >> this is a lawyer's full deployment act. number one, it's on church grounds. you've got somebody who is there who knew about it at the time. i can't even imagine the insurance companies must be reserving millions of dollars. >> if they have it. >> if they have insurance because this has got to be

. >>> let's bring in mel robbins, cnn commentator and legal analyst. i'm going to play the other side in this, mel, because i know you know the case very well. of course you get upset when people say you look like the guy suspected in a crime and disappear for hours. that's an embarrassing situation. what is the proof? there's curious things here, we keep hearing they're strengthening links. what do you think they actually have on this guy? >> i think they have either dna evidence that links harrington to him. or they have some sort of forensic evidence that they found at his house, chris. >> but no charges? >> but no charges yet. you're absolutely right. this is, they're at the stage where they've got all of these little bread crumbs and they're trying to amass enough so that they can actually make charges stick in this. what you don't want to have happen is you don't want to overreach. you don't want to overcharge. because the families are so devastated. and you also have all of these possible links, we're not only talking about the morgan harrington

i want to bring in legal analyst mel robbins and danny on this. some of the other material in the doumss so troubling on their surface. let's just say that. doodles and drawings and pictures of an isis flag and words saying come to jihad and, you know, in arabic, islamic state, here to stay, we are the lions of war, my nation, the dawn has emerged. is that, though, danny, material support? that's what he's charged with. >> the question ultimately, what is mere association and what is criminal material support under this federal statute, which is very broadly written and the supreme court has endorsed this broad interpretation of criminalizing membership or providing material support. now the statute speaks of providing things like personnel, expert assistance, money, and the question here is, what exactly has this 19-year-old defendant provided? when you look at it, you can equally say, doodles, at what level are doodles evidence against me that will go -- that are probative of my material support. you can, again, as broadly as this statute is wor

we want to bring in cnn commentator and legal analyst mel robbins and forensic scientist lawrence kobilinsky. mel, this guy goes into the police voluntarily, walks in with no lawyer. now ten days later it seems like investigators in virginia are emptying file after file all their case files finding possible links to him. how do we get from one place to another? >> basically he was wanted for questioning. he wasn't a suspect yet because he was the last person seen with hannah graham. and so he goes in to the police station as you said and presumably for questioning and says i want a lawyer. they made a decision at that point because the d.a. was there when he walked in that they didn't want to question him because if they heard anything they wanted to use it in court. i thought they thought if they followed him he'd lead them somewhere and they lost him in the chase. he's implicated in a string of crimes that span 12 years. larry and i think this is the tip of the iceberg. >> in terms of implicating the actual only liching they told us and a lot of this is based on leaks we get from the inves
