. >>> valero is facing an antitrust battle with the state over plans to buy storage terminals in the east bay. as kpix 5's anne makovec reports, california's attorney general is speaking out on his belief that the move would lead to higher gas prices. >> reporter: the attorney general set up his news conference today in front of this valero gas station to emphasize that its normal drivers they are trying to protect. valero owns this refinery in benicia but wants to expand, buying petroleum terminals in martinez and richmond. california's attorney general is trying to block the move, filing an antitrust lawsuit saying if the sale is approved, all petroleum terminals in northern california would be controlled by refineries raising concerns about competition and the possibility of higher gas prices. >> we believe this is not only critical for california's consumers, but it is indispensable to keeping competition, the basis of prices of gasoline throughout california. >> reporter: but valero says it does not compete with plains all american pipeline, the company that owns the terminals.

. >>> chemical flaring is expected to continue through the night at the valero refinery in benicia. hundreds of people fell sick earlier. the sky was filled with thick black smoke. christin ayers is in benicia with why the refinery says it could happen again. >> reporter: tonight you can still see the flaring from the valero refinery smokestacks. evacuation orders have been lifted, but tonight residents are lift wondering will this happen again if there's another electrical outage? it began with a power outage at the valero refinery, the first sign, a fiery flare and plumes of black smoke leaving some people gasping for air. the smoke left the air hazy and forced evacuations of two elementary schools and a nearby industrial park. a valero spokesman tried to explain that without the flaring system a power outage could be catastrophic. >> the equipment would fail. it would rupture and you release this material uncombusted which is a far more hazardous outcome. >> reporter: but he admitted after an expansion in 2002 the refinery does not have strong enough backup generators to prevent

(darya) the mayor of benicia is proposing new regulations for the valero oil refinery. this comes after a flaring event earlier this month that sent thick, black smoke into the sky. the flaring happened back on may 5th when there was a major power outage at the valero refinery. nearby offices were evacuated, two elementary schools were ordered to shelter in place, and a dozen people were taken to the hospital. now mayor elizabeth patterson says the refinery needs additional oversight. she is proposing that the city adopt a new safety ordinance that would prevent future chemical releases, and create a safety plan for the community. (darya) valero says a new safety ordinance is unnecessary because safety rules are already put in place by the state. but mayor patterson says the new rules would hold the refinery accountable

drivers who filled up recently at a valero gas station are being urged to check their bank statements. a high-tech skimming device it was found inside one of the gas pumps at that station on highway 101. dozens of victims have already come forward. >> chase called me. there was $500 on saturday, and $500 yesterday. >> reporter: a thousand dollars was withdrawn from corina's bank account after she swiped her card at this pump at the valero station in gilroy. police say it's a crime migrating from southern california to the north. so have you ever seen this kind of thing before? >> no it's pretty rare around here. in southern california, it's more prevalent. >> reporter: monday, at least 40 victims came forward, filing complaints of credit and debit card fraud, and that number could grow. investigators found a car skimmer similar to this installed inside a gas pump. they say it could have been hidden for over a week, collecting thousands of victims' information. >> we tend to think that it might be either a crew, or somebody with a lot of local contacts, or somebody with contacts that a

joycelyn moran joins us live from a valero gas station. what's it looking like? >> reporter: i think many of us have felt the pain of seeing the price it takes for our tank to fill up rising and rising. here at the valero on airport boulevard the price is $5.19. this isn't the worst. take a look. that's nearly $6 at a shell station in san francisco. this is on 4th and bryant. according to aaa, average gas price in california is $4.65, highest of any state and it's much higher than national average of $3.42. even the national average is higher than a year ago. aaa says it was $2.11 a year ago. high gas prices come as we approach the holidays when people are expected to travel and aaa expects traveling to be close to prepandemic numbers. as far as gas prices, new forecast from the federal government predicts prices will hold steady and drop back down next year. >> it's going to be messy, 53 million traveling, that's the estimate for aaa. most are by car. even with high gas prices the pain at the pump is not translated into people not going. the good news is if you

valero is suing pg&e... claiming the utility company caused 75- million dollars in damage to its benicia refinery. the lawsuit stems back to a power outage in may. valero says p-g-and -e shut off its electricity without notice. the loss of power forced an emergency shutdown of the refinery and caused extensive flaring that sent black smoke billowing into the sky. valero was fined for that flaring.
